Workshop Terms of Service

1. validity of the terms of service

The following general terms of service (ToS) apply to all workshops conducted by Johannes Wilske Photography in the field of photography. They are regarded as agreed if they are not disagreed with immediately.

 

2. registration

The contract is concluded by your registration for a workshop via the online registration form on the homepage www.johanneswilske.com. Your registration will be confirmed by e-mail and is binding from the date of confirmation.

 

3. workshop fees

The prices published on the homepage at the time of booking apply. Together with the booking confirmation you will receive an invoice for the workshop fee by e-mail. The deposit fee must then be transferred in advance, within 14 days of receipt of the invoice to the specified bank account. The full amount without deduction must be paid at least 30 calendar days before the workshop or however long specified on the specific workshop page. Participation in the workshop is only guaranteed after timely payment. No sales tax report, as this is a small business according to §19 UStG.

 

4. cancellation of the course by the participant

The customer can withdraw from the booking before the beginning of the workshop without giving reasons. Cancellation must be made in writing by e-mail or by post. If the customer is unable to attend, he is entitled to provide a substitute participant at any time. The registration of a replacement participant does not incur any additional costs. If no substitute participant can be named for the booked date, a cancellation fee will be charged, regardless of the reason for the cancellation. The amount of the cancellation fee depends on the time of cancellation:

within a period of 30 calendar days or more before the trip, you may be charged with the deposit fee.

within a period of 30 to 15 calendar days before the trip, you may be charged with 50% of the workshop price.

within a period of 14 to 8 days before the trip, you may be charged with 75% of the workshop price.

within a period of 7 and less calendar days before the trip, you may be charged with 100% of the workshop price.

In case of non-appearance, the full workshop price will be charged.

 

5. cancellation or postponement by the organizer

The organizer reserves the right to cancel or postpone offered workshops, if the number of participants is too low, if there is an illness, an accident or other compelling reasons. In case of extreme weather, the course may be postponed or cancelled. If, despite the efforts of the organizer, you do not have time at the alternative date, you can participate in any other coming workshop. The organizer tries to find alternative dates for cancelled seminars. In case of cancellation without replacement, the participants will be informed immediately and already transferred participation fees will be refunded. Further claims of the participant, in particular claims for damages (cancellation fees for travel and/or hotel costs) in case of changes or cancellation of a workshop do not apply.

 

 

6. The taking place of the workshop

Please refer to the description of the specific workshop for the minimum number of participants required for the workshop to take place. If the minimum number of participants is not reached, we will refund the full workshop fee.

 

7. exclusion of liability

Any liability for personal injury and damage to property is waived. Participants are liable for their own actions. The organizer accepts no liability for loss of or damage to items brought in by workshop participants during the event, with the exception of liability for intent or gross negligence. Participation in all workshops is at your own risk. There will be no refund of course fees in the event of acts of nature beyond control, deviations from the course program or bad weather, which limits the photographic possibilities.

 

8. Travel

Travel to and from the workshop location is at the participant’s own expense and risk.

 

9. copyright

The organizer is entitled to the copyright of the photographs in accordance with the copyright law. The workshop participant of a photograph has no right to reproduce or distribute the photograph without the consent of the photographer. § Section 60 of the Copyright Act is expressly waived. The organizer is entitled to use the produced images for his own advertising purposes. The workshop participant gives his consent according to § 22 KUG. All documents and pictures which are issued for the purpose of the workshop are protected by copyright. A duplication of the entire text, or parts of it, is prohibited without written consent of the organizer and can be pursued legally.

 

10. vouchers

The voucher can only be redeemed for the amount paid for the voucher and not for the service stated on the voucher. The voucher is only valid once: on the booked date. A cash pay-out of the voucher value as well as a cancellation is not permitted. The voucher can only be redeemed according to availability. In addition to the indicated prices, the organizer charges shipping costs for the delivery. If a participant wishes to attend a workshop whose participation fee exceeds the voucher amount, the total participation fee can be paid in part by the voucher amount and in part by bank transfer. The organizer will send an invoice for the remaining amount along with the registration confirmation. Vouchers are valid for a maximum of 1 year from the date of issue.

 

11. information within the context of the Data Protection Act

Personal data collected within the process of workshop information and workshop registration will be stored and processed electronically, but will NOT be passed on to third parties. The customer has the right to request free information about the personal data stored by the organizer about him. In addition, the customer has the right to correction of incorrect data and the blocking and deletion of his personal data as long as there is no legal storage obligation.

 

12. place of jurisdiction

Place of performance and jurisdiction for all disputes is the photographer’s place of business.

 

13. Severability clause and final provision

Should any clause of this contract be invalid, this shall not affect the validity of the remaining clauses. The contracting parties undertake to replace an ineffective clause with an effective one that comes as close as possible to an effective regulation.
